Housing Update: Gary Lewis secures outright possession following lifting of possession stay in case concerning one of country's biggest ever benefit fraud cases


On 25 September 2020, following the lifting of the stay on possession claims on 20 September 2020, Gary Lewis, instructed by Onward Homes Limited, secured an outright possession order in a case concerning a joint tenant who had been convicted of being responsible for a six-figure benefit fraud.

Following a trial before Deputy District Judge Mawdsley in the County Court at St Helens, the Court found it reasonable, in light of that serious criminality, to grant permission to Onward Homes to enforce the terms of a possession order which had initially been suspended on grounds of rent arrears pursuant to the guidance set out by the Court of Appeal in Sheffield City Council v Hopkins [2001] EWCA Civ 1023.
