Marc Willems QC has secured a landmark victory in a clinical Negligence and Human Rights claim on behalf of patient who was groomed and sexually abused by her Care Co-ordinator. Marc led Peter Edwards and Prof Conor Gearty QC and secured a settlement the day before a three week trial was due to commence and then won the legal argument about whether the evidence and written submissions in the case, which formed the basis for the Judicial Declarations of breaches of Articles 2, 3 and 8 of the European Convention Human Rights, could be disclosed generally in accordance with open justice principles. In a Judgment handed down today, Mr Justice Fordham agreed with all the requests relating to Disclosure made by Marc and his legal team.
