Michael Elders was instructed by DAC Beachcroft, on behalf of the Defendant, to attend Liverpool County Court for the trial of H v A. The Defendant had admitted liability for the road traffic accident but disputed the Claimant’s £10,749.88 bill for the hire of a moped on credit. The Claimant relied upon a plea of impecuniosity, however in cross examination it was established that the moped involved in the accident was hired for £90 per week and the Claimant returned to this arrangement following the cessation of credit hire.
Despite being lower than the figures suggested in the Defendant’s own basic hire rates report, Michael successfully secured a reduction from the aggregate claimed rate, including extras, of £290.54 per day, to just £90 per week. With a slight reduction to period, the Claimant was awarded just £360.00 in relation to credit hire which equates to less than 3.5% of the pleaded value.
