HHJ Rawlings, sitting as a Judge of the High Court, dismissed the Claimants’ claim on the grounds of causation. The Judge preferred the evidence of the Defendants’ reconstruction and A&E experts and made findings about conspicuity and applicable perception reaction times in difficult night time driving conditions.
