Mussadak Mirza successfully represents Claimant in Limitation Appeal


Mussadak Mirza successfully acted in an appeal before His Honour Judge Freedman, the Designated Civil Judge for Newcastle County Court, in Gordan Nattress v Willwyn Construction Ltd and CPS (Civil Engineering) Ltd.

 

Mussadak had succeeded in a trial on the issue of limitation in a historic noise induced hearing loss claim relating to employment going back to the mid-1980s. His determination to win the case was noted by Recorder Hodgson who commented that “Mr Mirza argued his case well and, indeed, passionately, saying everything that he could possibly say to persuade me…” (para.40).

 

The Defendant appealed the decision on three grounds. After hearing submissions, HHJ Freedman refused permission to appeal on all grounds. Mussadak was instructed by Eadie Stobbs and Rebecca Bennett of Baker & Coleman Solicitors. The Defendants were represented by DAC Beachcroft and instructed Jim Hester, Counsel of Parklane Plowden.

 

This follows his successful appearance last year at another appeal concerning limitation in a noise induced hearing loss claim. Mussadak successfully acted for the Claimant at first instance in Robert Cornwall v Shoesmith & Hughes before District Judge Wright. The Defendant appealed on multiple grounds. At an Oral Reconsideration Hearing, His Honour Judge Pema, the Designated Civil Judge for Leeds County Court, refused permission to appeal.
