Richard Hartley KC and Jonathan Boyle have recently achieved a £7.5M settlement for a client who suffered a spinal cord injury in a road traffic accident which rendered him paraplegic. Whilst primary liability was admitted, contributory negligence remained in issue.
The client was a remarkable individual who had enjoyed a career in the army prior to his injury. In spite of the challenges he faced and the opinions of his treating physicians, he made enormous progress with his rehabilitation to the point he was competing in high level wheelchair sport in North America and was using an exoskeleton. He was able to almost entirely self-care and the question of quantum largely turned on at what point in the future he would lose his physical capabilities.
