Marc Willems KC is delighted to be able to report that he and his Junior, Jonathan Boyle, both of Cobden House Chambers, Manchester have been able to settle the case of DDM on terms which were approved by the High Court on the 27th November 2023.
DDM suffered catastrophic injuries including a very severe brain injury in an accident which occurred on the 10th September 2018. The Claimant will require 2:1 care 24/7 for the remainder of his life. The settlement involves a lump sum payment of £4.5m plus a Periodical Payment Order of £350,000 payable each year on the 15th of December.
Unusually, the Defendant agreed to apply the index increase to the first payment due on the 15th December 2023 and every year thereafter. Again, unusually, whilst the Claimant agreed to a passive reverse indemnity which would allow the Defendant to receive the benefit of any statutory funding the Defendant agreed to allow the Claimant’s financial deputy to retain the first £40,000 ( also index linked) which might be recovered from statutory providers.
